Welcome to the Title IX Office

“No person in the United States shall, on the basis of sex, be excluded from participation in, be denied benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance.” (Title IX)

Marshall University is committed to providing a safe, non-discriminatory environment for all members of the University community. The University prohibits Discrimination, Harassment, Sexual Harassment, Sexual Misconduct, Domestic Misconduct, Stalking, and Retaliation by or against any member of the University community. These forms of Prohibited Conduct are defined in the Marshall University BOG GA-3 Policy.

Marshall’s Title IX Office is a neutral office. Where investigations are launched, both parties have equal rights throughout the investigative process. Both parties are permitted one advisor and two support people. Both parties are Noticed of the investigation,  any available hearing or appeal rights and procedures, how to obtain a copy of the investigation report, the final determination, and any sanction imposed

Retaliation: Marshall Policy prohibits retaliation against any person based on their participation in the investigation, reporting, remedial, or disciplinary processes. Retaliation includes adverse actions such as threats, intimidation, harassment, and coercion. The prohibition protects all participants in the investigation process (including witnesses). Retaliation will be treated as a separate violation under Marshall Policy, and any student or employee who engages in retaliation may be subject to discipline.

REMINDER ABOUT AMNESTY POLICY
Marshall’s highest priority is the physical and mental health, safety, and well-being of individual Students and the campus community. An element of promoting safety is providing clear, responsible methods of reporting and addressing incidents of sexual violence/misconduct.

Therefore, in order to remove potential barriers to reporting sexual violence/misconduct, Marshall may not charge students participating in the Title IX process with violating any Prohibited Conduct or the Student Code of Conduct regarding the personal use of alcohol and/or other drugs if they report such conduct within a Title IX matter.

Recognized Student Organizations may also qualify for amnesty if a member(s) of that organization reports Prohibited Conduct to the Title IX Office in good faith.
