Explore the Title IX Process

The Title IX Office conducts prompt, fair, and impartial investigations of sexual misconduct, Title IX sexual harassment, other gender/sex based discrimination, allegations of pregnancy and pregnancy related condition discrimination experienced by students, that avoid pre-judgment of facts at issue, conflicts of interest, and bias. The presumption is that no policy violation has occurred unless proven otherwise by a preponderance of the evidence in an adjudication process.

Anonymous Reports or Desire Not to Pursue Investigation/Disciplinary Action

While we do what we can to ensure confidentiality, due to certain rights and responsibilities, we may not be able to honor these types of requests for the following reasons:

  1. There can be no anonymity if punitive actions are taken against Respondent.
  2. Confidentiality is an aspiration but is not always possible or appropriate.
  3. Marshall may be limited in its response and investigation if confidentiality is requested.
  4. When Complainant requests no investigation, Marshall has to balance the request for privacy with the institutional responsibility of ensuring a safe educational environment and workplace.
  5. If possible, a report may be pursued without Complainant’s participation in the investigation or resolution. A review will be made to determine if there are security camera recordings, corroborating reports from other witnesses, physical evidence, or any evidence showing Respondent made statements of admission or otherwise accepted responsibility for the prohibited conduct.

The Title IX Office remains available for support/questions/resources for the parties regardless of Complainant not wanting to proceed.

Important Update: Online Reporting Transition

Beginning Oct. 27, 2025:

The Title IX Office will move to an online-only reporting system. This change reflects a growing trend among Title IX offices nationwide and is designed to help us better serve our campus community.

Our goal is to ensure that Title IX reports are reviewed promptly and thoroughly. In-person and phone submissions, while often well-intentioned, can sometimes involve complex concerns that fall outside the scope of Title IX. These conversations, though important, can require significant time and follow-up, which may delay our ability to respond to Title IX matters with the urgency they deserve.

By centralizing reports through our secure online system, we can more efficiently triage concerns, prioritize Title IX cases, and maintain a consistent and equitable response process for all students, faculty, and staff.
